I. POLICY AND GENERAL STATEMENT

The University of Texas Health Science Center at Houston ("University") may grant employees unpaid leaves of absence for a variety of reasons. Except for extended military leaves of absence and leaves of absence granted under the Family and Medical Leave Act of 1993 ("FMLA") or the Americans with Disabilities Act Amendments Act ("ADA"), the eligibility requirement for all unpaid leaves is that employees must be appointed for at least 20 hours per week for at least four and one-half months.

Granting a leave of absence signifies the employee's position will be restored when the employee returns. When a leave is approved, it is the responsibility of the department to ensure the employee's position will be available at the appropriate time. When an extended military leave of absence is granted, the University assumes responsibility for restoration of the employee's original position, or one of like seniority, status and pay. The University allows for unpaid leave under the following circumstances:

Note: During the 12-work week period of family and medical leave and during the 12-work week period of parental leave, an employee is required to substitute any accrued sick leave (if applicable), vacation leave, compensatory time, and administrative leave available to remain on paid status. (Refer to HOOP Policy 106 Family and Medical Leave or to HOOP Policy 107 Parental Leave.)
